5.2 REMARKETING AND ONLINE ADVERTISING

We use data for analytics and advertising purposes. We share data with 3rd party providers including Facebook and Instagram.  We target consumers through online advertising so you may see ads on social media based on your personal information and browsing history.

We may use Facebook Pixel and Google Analytics to deliver targeted advertisements to individuals who visit our website.

We will only retain your personal data for as long as is necessary to fulfil the purposes for which it is collected.

7. ABOUT DATA STORAGE AND DATA TRANSFERS

​Your personal data may be stored in a number of locations as Matt Gillard Fitness uses a combination of UK, cloud-based and international server storage, including the platform provider (WIX). WIX is a global company. Your personal information may be stored in data centres located in the UK, United States of America, Ireland, Japan and Israel. WIX may use other jurisdictions as necessary for the proper delivery of our Services and/or as may be required by law.

 

7.1 TRANSFERRING PERSONAL DATA OUTSIDE THE EUROPEAN ECONOMIC AREA (EEA)

Wix is a global company that respects the laws of the jurisdictions it operates within. The processing of the User Customer Data may take place within the territory of the European Union, Israel or a third country, territory, or one or more specified sectors within that third country, of which, the European Commission has decided that it ensures an adequate level of protection. Wix.com Ltd. is based in Israel, which is considered by the European Commission to be offering an adequate level of protection for the Personal Information of EU Member State residents.

 

Any transfer to a third country, outside the European Union, that does not ensure an adequate level of protection according to the European Commission, will be undertaken in accordance with the Standard Contractual Clauses (2010/87/EU) set out in Appendix 1 of the Wix Data Processing Agreement (DPA)  Wix affiliates and Third-Party Service Providers that store or process your Personal Information on Wix’s behalf are contractually committed to keep it protected and secured, in accordance with industry standards and regardless of any lesser legal requirements which may apply in their jurisdiction.

7.2 TRANSFER OF EU PERSONAL DATA

If you are located in Europe, when we will transfer your Personal Information to the United States or anywhere outside Europe, we will make sure that (i) there is a level of protection deemed adequate by the European Commission or (ii) that the relevant Model Standard Contractual Clauses are in place.

7.3 PRIVACY SHIELD CERTIFICATION

Wix and its affiliates, including DeviantArt Inc., participates in, and has certified its compliance with, the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework. For the avoidance of doubt, Wix does not rely on the Privacy Shield as a mechanism for transferring GDPR protected personal data.

8. DATA SECURITY
We have put in place commercially reasonable and appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.
We have put in place procedures to deal with any suspected data security breach and will notify you and any applicable regulator of a suspected breach where we are legally required to do so.

 

8.1 DATA BREACH
We shall promptly notify customer/user, as soon as reasonably practicable and not later than 72 hours from the time of confirmation by Matt Gillard Fitness of unauthorized access, use, or disclosure of any Customer Data, Customer’s Confidential Information, or Personal Information under our control. We shall provide Customer/User with information regarding such incident as required by our breach procedure, which can be obtained by email at info@mattgillardfitness.co.uk or as reasonably requested by the user and to comply with its Applicable Law. Matt Gillard Fitness shall use commercially reasonable efforts to: (i) identify the cause of the incident and (ii) remediate the cause of the incident within our IT systems of Website Platform (WIX), to the extent such remediation is within Matt Gillard Fitness reasonable control. 

9. RIGHTS OF ACCESS, CORRECTION, ERASURE, AND RESTRICTION
It is important that the personal data we hold about you is accurate and current. Should your personal information change, it is your duty to notify us of any changes of which we need to be made aware by contacting us, using the contact details below.

9.1 YOUR RIGHTS IN CONNECTION WITH PERSONAL DATA
